The Evidentiary Value of Electronic Writing in Administrative Contracts Under UAE and Comparative Legislation

The study aimed to identify the evidentiary value of electronic writing in administrative contracts under Emirati and comparative legislation, adopting the comparative analytical method to examine the relevant legal texts, jurisprudential opinions, and judicial approaches. The study reached several significant findings, foremost among them that the French legislator has expressly recognized electronic writing as a means of proof equivalent to traditional written documents, provided that the identity of its source can be reliably established and that its content is safeguarded against alteration. French legislation has thus entrenched the principle of equality between electronic and paper documents in terms of their legal evidentiary value within the framework of administrative contracts. In parallel, the UAE legislator has taken advanced and proactive steps by enacting the Electronic Transactions and Commerce Law, which accords electronic documents full evidentiary force when they satisfy prescribed requirements of security, reliability, and documentation. Emirati legal texts further confirm that electronic writing constitutes a valid and effective means of proof in administrative contracts, reflecting the state’s broader policy orientation toward digital transformation and e-governance. The study also highlights the practical implications of these legislative developments for administrative practice and judicial adjudication, demonstrating how the recognition of electronic writing enhances legal certainty, facilitates the modernization of public administration, and supports the efficient conclusion and execution of administrative contracts in a digital environment.

تُعد العلاقة بين السلطة التأديبية للإدارة وحقوق الموظف من أبرز القضايا الحساسة في القانون الإداري الحديث، حيث تتقاطع المصلحة العامة مع حماية حقوق الموظفين. تهدف الدراسة إلى إبراز التوازن المطلوب بين حق الإدارة في فرض الانضباط وضمان حقوق الموظف من التعسف أو الإضرار بكرامته واستقراره المهني. تعتمد الدراسة على منهج تحليلي مقارن، حيث تُحلل نماذج تشريعية من الإمارات، فرنسا، ومصر، لتحديد أوجه التشابه والاختلاف في الضوابط القانونية والإجراءات التأديبية، ومدى تحقيقها لتوازن عادل بين الانضباط وضمانات الموظف. تتناول الدراسة الأسس القانونية للسلطة التأديبية وحدودها، إضافة إلى الضمانات التي تحمي الموظف مثل حق الدفاع، الاستئناف، والرقابة القضائية. كما تقارن بين التشريعات من حيث تنظيم المخالفات، تدرج العقوبات، آليات التحقيق، ومستوى الشفافية والعدالة في الإجراءات. تشير الدراسة إلى تأثير الاتفاقيات الدولية، خصوصًا اتفاقيات منظمة العمل الدولية، في تطوير نظم العدالة الإجرائية وحماية حقوق الإنسان في بيئة العمل. ختامًا، توصي الدراسة بتقنين الإجراءات التأديبية، إنشاء هيئات مستقلة، تعزيز الشفافية، وتفعيل آليات التسوية البديلة، مؤكدة أن التوازن بين سلطة الإدارة وحقوق الموظف ضرورة لضمان العدالة الإدارية وبناء الثقة وتعزيز فاعلية المؤسسات العامة.
